Czech Labor Code - Termination of employment contract by employer

The notice from the employer must be in writing and must contain a specific legal reason (e.g., redundancy or medical incapacity).
Without your consent, it cannot be given to you during the so-called Protection Period (e.g., for sick leave).
A notice period always applies, and in certain cases, you are entitled to severance pay.

📜 Basic requirements for notice
The employer cannot just give you notice. The reasons are strictly stipulated by the Labor Code.

1. Written form: The notice must be properly delivered to you (ideally in person against signature or by registered mail).
2. Exact reason: The reason must be clearly described and cannot be changed later.
3. Protection period: The notice is invalid if you are on sick leave, on maternity or parental leave.
4. The notice period is at least 2 months by law. It starts on the first day of the calendar month following the delivery of the notice.
If you are dismissed for serious breach of work duties (or failure to meet requirements), the notice period is 1 month and starts on the day of delivery.

💰 Severance pay
If you are dismissed for organizational reasons (e.g. your position or the entire company is being abolished), you are entitled to severance pay:
1-times your average earnings (if the employment relationship lasted less than 1 year).
2-times (if the relationship lasted 1 to 3 years).
3-times (if the relationship lasted more than 3 years).

📝 What should you do if your employer (suddenly and unexpectedly) presents you with a notice of termination of your employment contract:
Do not sign it right away!!
If your employer offers you a "termination by agreement", think carefully about the terms - the agreement cannot be easily challenged as an invalid dismissal.

Observing deadlines: If you disagree with the dismissal and believe it is invalid, you must file a lawsuit to determine the invalidity of the dismissal in court no later than 2 months from the date on which the employment relationship was to end.

Labor Office: If you are terminated, report to the Labor Office no later than THREE DAYS (even in the case of termination by agreement, if there was a serious reason for it and file an application for unemployment benefits

As soon as we receive your photocopies, we will prepare followed:

 1) the INCOME TAX RETURN form

2) AFFIDAVIT for the period without global taxable income in 2025

3) We will calculate the amount of the underpayment/overpayment

After we are done, we will inform you about the result of the calculation and agree on an appointment in your local Finance Authority (FÚ) where you meet our interpretor who will bring your printed and filled forms.

On this day and at the agreed time, you will be assisted and interpreted in submitting the above-mentioned, pre-filled, and checked documents at the tax office counter in Cheb, Sokolov, or Karlovy Vary.

If you are living outside of the region districts Cheb, Sokolov, Karlovy Vary,

instead of a personal meeting, we will send you all pre-filled documents by post mail, and you just need to bring them to the tax office counter. If you have a question about the serving officer you do not understand, we will assist you and interpret for you over the phone.

Our fee of 500 CZK is payable immediately upon submission on-site via the QR code banking application, or in cash or against a receipt. If we are assisting you remotely, we will end you and invoice you 500 CZK online.

Who should file an income tax RETURN?

Since we do not want our clients to pay a higher fee for assistance in filing an income tax RETURN than the expected overpayment, we would like to inform you who should file an income tax RETURN.

Definitely employees who came to the Czech Republic for work for the first time and started working in 2025 should do it. Based on our experience with these clients, their refunds ranged from CZK 5,000 to CZK 17,000.

In contrast, the refunded overpayments to employees working in the Czech Republic for 2024 were significantly lower, often only a few hundred crowns.

The reason is the automatic reduction of tax advances after the first year of work in the Czech Republic due to higher overpayments.
